从传媒与司法的关系入手，分析了新闻自由与司法公正2种价值的冲突与契合。为了平衡媒体与法院的关系，美国的新闻制度与理念构造筑就了西方传统英美法系的传媒监督与司法公正的模式，针对中国目前传媒与法院的紧张关系，借鉴国外立法，合理构建中国特色的传媒与司法的契合机制，从而促进司法公正与新闻自由在中国得到广泛的认同与更切实的保障。

The article studies the relations between the media and the judicature and analyzes two kinds of values of the conflict and the conjunction between the freedom of the press and the fairness of judicature. To balance the relations of the media to the court, the American news system and their ideas built on the western tradition of Britain and America legal system have established the pattern of the media surveillance and the judicial fairness. Considering the tension of the media and the court at present in China, it is of great importance to refer to over- seas legislation and reasonably construct the conjunctional mechanism of the media and the judicial with Chinese characteristics so as to promote the widespread approval and a more practical safeguard of a judicial fairness and a freed press in China.
