与国家法相对,民间法自生发于有限地域当中,其对特定群体的规制效果长久以来被归因于法律文化的传承,然而文化论的解释对于民间法何以能够成为法,何以能够成为文化,进而何以能够为个体所遵守却不能给出令人信服的答案,法经济学原理的分析进路为我们提供了找出深层原因的依据。因此,我们有必要以经济学原理为分析工具,揭示民间法在生成、运作及发展过程中为个体所接受并产生规制实效的原因所在。

Contrary to the national law, folk law generates from a limited zone in spontaneity, and its validity to particular community is always ascribed to the succession of legal culture, but the interpretation of culture can＇ t offer us a satisfactoy answer on why the folk law can become a law, culture and be obeyed by individuals. The approach of economy principles offers us basis for finding out the deep causes. This article, by taking economy principles as tools of analysis, reveals the reasons of folk law being accepted and thus abided by individuals in the course of its generation, operation and development.
