流浪儿童犯罪控制和权益保护已成为一个现实和理论的新问题,而问题的系统性破解,需要多学科、多范式研究的协同。在发展学和法学视域,由于流浪儿童问题特有的未来性和负面性,流浪儿童保护对和谐社会建设有着不可忽视的重要意义。以流浪儿童正常发展为中心点,流浪儿童犯罪控制和权益保护具有内在关联。流浪儿童犯罪基本上属于“穷犯罪”,其主要成因包括经济失衡、教育失当、家庭失和、控制失利。应当统筹流浪儿童犯罪控制和福利救济两大思路,统筹生存性救助和发展性救助,统筹犯罪惩治和预防,统筹犯罪控制和权益保护的社会环境要素。

Crime control of waifs and their rights protection has become a new problem in reality and theory. Its systematic approach should be based on the cooperation of muhidisciplinary and multi-paradigm research. In the light of the development study and law, the waifs＇protection is crucial to constructing harmonious society because of the tendency and negatire effect of the waifs＇ problem. There is an intrinsic relationship between the crime control and rights protection around the center of waif＇ regular grow. Waifs commit a crime for survival, which results mainly from economical imbalance, improper education, family inharmony and control setback. We must place emphasis on crime control and welfare relief on waifs. And we must try to achieve an integration Of survival relief and developmental relief, of punishment and crime prevention, and of crime control and rights protection.
