黔东南雷山县的永乐镇和达地水族乡的少数民族主要有苗族、水族、侗族、汉族等，由于位于四县交界地带，此地社会治安一直不好，频繁出现的与牛有关的刑事和民事案件（文中称“涉牛”案件）及纠纷，当地在处理和解决这些案件和纠纷过程中国家法与民间发生明显的冲突。目前国家法在少数民族地区尚不完全具有应有的“亲和力”，在少数民族地区不容易渗透或者渗透不深。如果民间习惯法能够有效“定分止争”，就不必用国家法来解决，以防止各族群众卷入无谓的纠纷或陷入旷日持久的、最终难有结果的诉讼之中，从而达到节约司法资源，有效降低解决矛盾纠纷的成本，提高司法效率，稳定民族地区社会秩序的效果。

This article is a case study of two villages, Dadi and Yongle, of Leishan county （ southeast of Guizhou Province. Due to the local sgeographical conditions and the production mode, until now, the stealing of farm cattle is still a common public security issue which is difficult to solve. Such cases have also caused some other social problems that have affected seriously normal production and social order. Through our field study, we found that the cases of stealing farm cattle are directly related to traditional mode of production and the habits and customs of the Miao nationality. The local people have different customs and practices concerning such cases. This study is an attempt to find solutions to such an issue.
