美国产品责任法对许多工业化国家的产品责任立法有重大影响，从某种意义上讲，其基本理论的演进是生产和消费双方博弈的结果，正是这种博弈催生了法律制度的最优战略选择。本文在分析美国产品责任法发展历史的基础上，用博弈论的方法分析了不同产品责任制度下的战略选择，并对我国产品责任法从理论基础、赔偿范围和标准等方面提出了有针对性的建议。
美國產品責任法對許多工業化國傢的產品責任立法有重大影響，從某種意義上講，其基本理論的縯進是生產和消費雙方博弈的結果，正是這種博弈催生瞭法律製度的最優戰略選擇。本文在分析美國產品責任法髮展歷史的基礎上，用博弈論的方法分析瞭不同產品責任製度下的戰略選擇，併對我國產品責任法從理論基礎、賠償範圍和標準等方麵提齣瞭有針對性的建議。

The product liability law of the United States brings great influence on many industrialization countries, In some way, the development of basic theory of its product liability law is the result of the game between producers and customers. It is the game that gives birth to the most excellent strategy choice of legal system. On the basis of analyzing and the development history of American product liability, the author analyses the strategy choice about product liability system in game theory. It is the author＇s expectation to perfect and develop our country＇s product liability law.
