由交通赔偿引发的“好望角问题”争议，其实质乃是现行交通赔偿制度设置遵循了实证主义法学之规则。现行交通赔偿机制忽视了价值标度，并不具备制度的正当性。建构正当性的交通赔偿制度，必须遵循新自然法学派富勒所主张的，从确立正当的价值标准入手，并以正当的价值作为制度的内涵。正当性的交通赔偿制度就是以平等为标度，平等为内核。
由交通賠償引髮的“好望角問題”爭議，其實質迺是現行交通賠償製度設置遵循瞭實證主義法學之規則。現行交通賠償機製忽視瞭價值標度，併不具備製度的正噹性。建構正噹性的交通賠償製度，必鬚遵循新自然法學派富勒所主張的，從確立正噹的價值標準入手，併以正噹的價值作為製度的內涵。正噹性的交通賠償製度就是以平等為標度，平等為內覈。
유교통배상인발적“호망각문제”쟁의，기실질내시현행교통배상제도설치준순료실증주의법학지규칙。현행교통배상궤제홀시료개치표도，병불구비제도적정당성。건구정당성적교통배상제도，필수준순신자연법학파부륵소주장적，종학립정당적개치표준입수，병이정당적개치작위제도적내함。정당성적교통배상제도취시이평등위표도，평등위내핵。
The essence of the ＂Cap of Good Hope Question＂ dispute caused by traffic compensation is that the setting of the current traffic Compensation system has followed the rule of positivism law. The current traffic compensation system has ignored value scale, so it has no system legitimacy. We must begin with legitimate value standard and take legitimate value as the connotation of the system protested by L. L. Fuller of Neo-natural School of Law to construct the legitimate transportation compensation system, which takes equality as the standard and the core.
