从一定意义上说，多余指定原则是在对法律的误解中产生的，存在很多弊端，如法院在适用该原则后，一些专利能否还成为专利值得考虑；侵犯了法的确定性原则，损害公众利益，阻碍技术创新和进步；与国际不接轨，给我国专利的世界性保护带来不便；与我国的法律体系相矛盾；不利于专利代理人和专利代理待业的发展。

This paper carries out a theoretical analysis of the legal basis of the superfluity establishment principle. It is claimed that intellectual property right ensures the protection of the benefits of the owners in addition to the public interests. The establishment of right impingement is to take into consideration both the privacy properties of the patent and the equality of benefit shares.
