根据《劳动教养试行办法》的相关规定,在劳动教养执行过程中,劳动教养管理委员会可以委托劳动教养管理机关对违反劳动教养管理制度的劳教人员作出延长劳动教养期限1天以上1年以下的处罚。在实际工作中,劳教管理机关注重的是处罚的实体公正,忽略了处罚的程序公正。听证制度的引入能够赋予劳教人员在处罚过程中进行陈述、申辩、质证的权利和机会,使处罚更为公平合理。

근거《노동교양시행판법》적상관규정,재노동교양집행과정중,노동교양관리위원회가이위탁노동교양관리궤관대위반노동교양관리제도적로교인원작출연장노동교양기한1천이상1년이하적처벌。재실제공작중,로교관리궤관주중적시처벌적실체공정,홀략료처벌적정서공정。은증제도적인입능구부여로교인원재처벌과정중진행진술、신변、질증적권리화궤회,사처벌경위공평합리。
Applying the hearing of witnesses system to punishing the inmates in reeducation -through -labor is of great importance for promoting its administrative work. In practice, the administrative organs of reeducation - through - labor attach much importance to the substantial impartiality of punishment, ignoring its justice of procedure. The introduction of the hearing of witnesses system offers the inmates in reeducation - through - labor the right and opportunity to state,to defend and to cross - examine during the course of punishment ,making the punishment more equitable and reasonable.
