文章通过分析中国现存不动产登记现状,认为不动产登记交由行政机关负责更为妥当,土地管理部门进行登记是我国立法的必然选择。提出我国应确立不动产登记的实质审查,并建立审查责任的分化制度,因登记机关的过错造成当事人损害的,国家应承担赔偿责任。

The paper analyzes the existing situation of Chinese real estate registration. In my opinion, it is reasonable that government should take charge of registration. Specifically speaking, the land management department should take up it. China should establish the substantive examination system about real estate registration. The examination responsibility should be assigned. The government should undertake the liability of compensation when the registration organ's mistake causes the litigant to harm, for the essence of registration organ's liability of compensation belongs to the civil compensation.
