重刑主义曾在人类历史上有着辉煌的时代，也曾经起到重要的作用。但随着时代的进步，重刑主义已经逐步在人类社会呈现蜕变的趋势。笔者从社会结构变化、犯罪学研究新成果的影响、行刑效果与刑罚经济思想的影响、刑罚人道化、合理化思想的影响等角度并结合历史与现实探讨了重刑主义已无滋生的土壤。
重刑主義曾在人類歷史上有著輝煌的時代，也曾經起到重要的作用。但隨著時代的進步，重刑主義已經逐步在人類社會呈現蛻變的趨勢。筆者從社會結構變化、犯罪學研究新成果的影響、行刑效果與刑罰經濟思想的影響、刑罰人道化、閤理化思想的影響等角度併結閤歷史與現實探討瞭重刑主義已無滋生的土壤。
중형주의증재인류역사상유착휘황적시대，야증경기도중요적작용。단수착시대적진보，중형주의이경축보재인류사회정현세변적추세。필자종사회결구변화、범죄학연구신성과적영향、행형효과여형벌경제사상적영향、형벌인도화、합이화사상적영향등각도병결합역사여현실탐토료중형주의이무자생적토양。
The severe punishment doctrine not only had a magnificent time, but also played an important role in the human history. However, the severe punishment doctrine is showing a decay tendency in the human society. I find that the severe punishment doctrine has no opportunity for breeding from all kinds of aspects including the changes of the social structure, the influence of the new achievement from criminology, the influence of the effects from penalty execution and economy of punishment, humanitarianism of punishment, rationalization of punishment and so on combined with the history and reality.
