从劳动教养的产生和发展来看，它以不恰当地牺牲个人权利为代价来维护社会秩序，始终是一种具有一定任意性的治理工具。从法治角度考察，劳动教养是具有刑事性的处罚措施，是典型的“中国式”轻刑。劳动教养的去向是，废除制度，保留功能。即，与中国《刑法》犯罪定量因素决定的实为较重犯罪和较重刑罚相对应，建立相应的对轻罪的轻刑制度。

종노동교양적산생화발전래간，타이불흡당지희생개인권리위대개래유호사회질서，시종시일충구유일정임의성적치리공구。종법치각도고찰，노동교양시구유형사성적처벌조시，시전형적“중국식”경형。노동교양적거향시，폐제제도，보류공능。즉，여중국《형법》범죄정량인소결정적실위교중범죄화교중형벌상대응，건립상응적대경죄적경형제도。
Seen from its emergence and development, reeducation through labor is always an arbitrary governance tool since it maintains social order by sacrificing individual rights as a cost. To analyze from the view of rule of law, reeducation through labor is a criminal punitive measure, a typical light punishment with Chinese characteristics. The fate of reeducation through labor is to abolish the system itself and keep its functions. This is to say, for corresponding to felony and its punishment detennincd by criminal＇ quantitative factors regulated by the Criminal Law of China, it should set up the light punishment system for misdemeanor.
