语言与法的关系水乳交融。现代法学和现代法学语言研究同步发展。法学研究的语言转向，促使“法律语言”向定义范畴更加广泛的“法学语言”发展。法学话语分析是研究大于句子的法律口头语言和书面语言组织。司法语境中模糊话语分析就是对涉案当事人的谈话风格、话语标记、会话序列以及会话含义等言语行为进行分析，为警察、检察官、法官和律师处理刑事或民事案件提供有力的语言证据支持，是实现程序公正和社会正义的必要手段。借鉴国外司法语言分析手段处理法律案件，是推进法制化建设的有机组成部分，也是丰富我国法学和法学语言研究的重要源泉。

Language and law are closely interrelated and their development is co - existent. Forensic linguistics is turning from legislative or judicial verbal system to a much wider scope--the language of legal science. Discourse analysis of legal science is actually to probe into the language structure of spoken or written form beyond word and syntactical levels through linguistic analytical methods. The vague legal discourse analysis in judicial contexts, on the one hand, is specifically characteristic of the persons involved in legal affairs so that, police officers, prosecutors, judges and lawyers may find solid testimony when they cope with and justify both civil and criminal cases and more importantly presents itself as a necessary strategy for helping to realize fairness in legal proceedings and social justice. Learning legal discourse analysis in judicial processes from western countries can enrich our knowledge in jurisprudential research on language of legal science.
