中国传统法律具有伦理法的特点，其主要表现为“十恶”、特权法以及男尊女卑。儒家的“礼”制思想是中国传统伦理法的思想根源，儒家用君臣、父子、兄弟、夫妻、朋友“五伦”规范社会等差关系，用“礼”作为维护社会等差关系的工具，形成中国传统法律意识。批判和改造传统法律意识，确立现代法律观念、法律意识是实现法治现代化必不可少的重要奈件。

The Chinese traditional law is featured as moralization, as can be seen in ＂ten heinous crimes＂, law of special privilege and male superiority; the ideology of it can be traced back to the Confucius thought of rite which standardized social class relations in terms of ＂five ethical relations＂ and a means to maintain the class relations,hence forming the Chinese traditional legal awareness. Therefore, to criticize and reform this awareness and establish modem legal principle and legal awareness is quite necessary for the modernization of rule of law.
