在民事诉讼中，如何确定证人资格是一个值得关注的问题。中国民事诉讼法对这一问题的规定较为粗疏，从而导致在司法实践中法官难以把握判断证人资格的标准。而证人资格的判断标准不统一将使法律适用的标准不统一，进而使审判的公正性遭受怀疑。为此应在借鉴国外相关立法的基础上，对我国民事诉讼证人适格制度中存在的问题提出有针对性的解决方案。

In civil proceedings, how to determine eligibility of witnesses is a matter of concern, which is incom- plete in civil procedure law of China, resulting in the judges have the difficulty on grasping the standards of judging witnesses in the judicial practice. However, the uncertain criteria of the witnesses will make the standards of applica- tion of law not unified, thereby bringing suspicion on fairness to the trial. Therefore we should present countermeas- ures for the problems in the system of proper witnesses in our country＇s civil procedure on the basis of foreign - related legislation for reference.
