刑法理论中的违法性认识不应仅局限于故意犯罪的场合来讨论。在把刑法理论中的违法性认识分为实质的违法性认识与形式的违法性认识之后，违法性认识应被扩展到过失犯罪场合和刑罚论中予以讨论。实质的违法性认识即社会危害性认识也是过失犯罪的成立必须联系的一个因素。实质的违法性认识与形式的违法性认识通常互为表里。形式的违法性认识既影响罪之成立，又影响刑之轻重。
刑法理論中的違法性認識不應僅跼限于故意犯罪的場閤來討論。在把刑法理論中的違法性認識分為實質的違法性認識與形式的違法性認識之後，違法性認識應被擴展到過失犯罪場閤和刑罰論中予以討論。實質的違法性認識即社會危害性認識也是過失犯罪的成立必鬚聯繫的一箇因素。實質的違法性認識與形式的違法性認識通常互為錶裏。形式的違法性認識既影響罪之成立，又影響刑之輕重。
형법이론중적위법성인식불응부국한우고의범죄적장합래토론。재파형법이론중적위법성인식분위실질적위법성인식여형식적위법성인식지후，위법성인식응피확전도과실범죄장합화형벌론중여이토론。실질적위법성인식즉사회위해성인식야시과실범죄적성립필수련계적일개인소。실질적위법성인식여형식적위법성인식통상호위표리。형식적위법성인식기영향죄지성립，우영향형지경중。
Knowledge of illegality in theory of criminal law should not be discussed only in the field of intentional crime. After being divided into knowledge of essential illegality and knowledge of formal illegality, knowledge of illegality should he expended to field of negligent crime and punishment theory to be discussed. Knowledge of essential illegality is also one of the elements that relates to the constitution of negligent crime. Knowledge of essential illegality and knowledge of formal illegality is outside and inside each other. Knowledge of formal illegality influences not only constitution of crime but also weight of punishment.
