采取有效措施保护雇员免受不公正解雇,确保被解雇者获得合理补偿,是保护劳动者工作权利的重要内容。本文从法律和经济角度比较了日韩两国不同的解雇保护制度,以及雇用制度实践的变化,分析了其有关解雇保护的基本理念和主要观点,认为放松经营性解雇(裁员)和临时用工的限制,已成为日韩两国解雇制度的一个共同趋向。
採取有效措施保護僱員免受不公正解僱,確保被解僱者穫得閤理補償,是保護勞動者工作權利的重要內容。本文從法律和經濟角度比較瞭日韓兩國不同的解僱保護製度,以及僱用製度實踐的變化,分析瞭其有關解僱保護的基本理唸和主要觀點,認為放鬆經營性解僱(裁員)和臨時用工的限製,已成為日韓兩國解僱製度的一箇共同趨嚮。

It is necessary for protecting work right of employees to take effective measures to protect employees from unfair dismissal and to ensure employees to get a reasonable amount of compensation. Comparing dismissal-protection systems between Japan and Korea from the perspective of law and economy and changes of their employment systems, this paper analyzes the basic idea and the basic concept of dismissal-protection and points out that lifting the ban of downsizing and employing temporary staff members is a common trend of Japanese and Korean dismissal systems.
