高校与教师逐渐从基于身份的任命关系转向基于契约的聘用关系,但由于高校与教师存在着不对称的聘用关系,教师业绩考核中的法制缺失以及教师权利保障的制度缺位,使得聘用过程中的契约关系难以落实。为此,完善高校中的聘任制度,规范教师业绩考核标准与流程,鼓励教师参与学校民主管理,完善教师权利保障体系,是完善高校与教师契约关系的根本途径。
高校與教師逐漸從基于身份的任命關繫轉嚮基于契約的聘用關繫,但由于高校與教師存在著不對稱的聘用關繫,教師業績攷覈中的法製缺失以及教師權利保障的製度缺位,使得聘用過程中的契約關繫難以落實。為此,完善高校中的聘任製度,規範教師業績攷覈標準與流程,鼓勵教師參與學校民主管理,完善教師權利保障體繫,是完善高校與教師契約關繫的根本途徑。

The relationship between Chinese universities and their teachers has gradually transformed from the identity-oriented appointment relationship to the contract-oriented employment relationship. However, the contractual relationship during the employment process can not be fully implemented due to the unequal employment relationship between such universities and their teachers, the legal void of the evaluation system for teachers' achievements and the institutional imperfection in protecting teachers' rights and benefits. Thus, perfecting the employment system in such universities, standardizing the gauge and procedure for evaluating the teachers' achievements, encouraging the teachers to participate in the democratic administration of such universities and improving the system of protecting teachers' rights and benefits have been the key to improving the contractual relationship between Chinese universities and their teachers.
