产权是信用存在的前提，产权明晰有强化信用的作用，而良好的信用对产权也有维护作用。内生信用的实质是契约的自我实施，互惠互利、相互约束以及关系契约是信用内生的重要条件。外生信用依靠第三方约束来实现。非正式的第三方约束依靠信息传播实现治理，而正式的第三方约束则依靠国家的强制力量保障契约的实施。公平公正是对第三方约束的内在要求。
