逮捕是一种剥夺人身自由的最严厉的刑事强制措施，是国家强制力的集中体现。它既有存在的正当性基础，又不是无限的。在现代法治社会越来越强调对人权的尊重和保障形势下，国家更不能任意侵害公民的合法权利。从规范国家权力运作、保障人权的角度讲，逮捕必须具有存在基础正当性、逮捕的正当性要件。
체포시일충박탈인신자유적최엄려적형사강제조시，시국가강제력적집중체현。타기유존재적정당성기출，우불시무한적。재현대법치사회월래월강조대인권적존중화보장형세하，국가경불능임의침해공민적합법권리。종규범국가권력운작、보장인권적각도강，체포필수구유존재기출정당성、체포적정당성요건。
Arrest is the most severe criminal coercive measure which deprives the physical liberty and is the concen- trated expression of the state coercive power. There is a legitimate but not unlimited basis of its existence. Under the situation that the modern society ruled by laws has been increasingly emphasizing on respecting and safeguarding human rights, a sate shall never arbitrarily trespass the legitimate rights of citizens. With respect to regulation of the state power and protection of human rights, there must be legitimacy basis and elements for the arrest measure.
