在建设和谐社会的背景下,对公共利益的救济成为关注的焦点问题。公共利益是公益诉讼的利益源头,以利益出发,对公共利益进行法权凝练,进而建构社会公益权这种新型的权利,并以此为权利契机,对公益诉讼的主体进行分析,赋予社会中间层组织以原告资格,是对现有权利体系与诉讼制度的完善与修正。
在建設和諧社會的揹景下,對公共利益的救濟成為關註的焦點問題。公共利益是公益訴訟的利益源頭,以利益齣髮,對公共利益進行法權凝練,進而建構社會公益權這種新型的權利,併以此為權利契機,對公益訴訟的主體進行分析,賦予社會中間層組織以原告資格,是對現有權利體繫與訴訟製度的完善與脩正。

Under the background of building a harmonious society, the relief of the public interest has become the focal point of concern. The public interest is the interests＂ source of public interest litigation. Based on interest, carrying out legislation refining to construct this new type of social welfare rights, and as a right opportunity to analyze the subject of public interest litigation, giving the social middle layer the plaintiff qualifications, so as to improve and correct the existing rights system and the litigation system.
