对西方国家的法律制度进行借鉴和移植，是我国司法融入世界进程的一个重要步骤。刑事和解是一种利弊兼有的制度，鉴于其只追求效率而忽略公正的特性，在引入该制度时，应设置更多的限制，将其作为我国现行职权主义诉讼模式的一种补充手段。考虑到中外间在法治环境上的差距，扩张式的引进并不成熟。

The study and borrowing of the legal system of the West is an important step for China＇s judicatory to enter the legal system of the world. The criminal reconciliation system has its advantages and disadvantages because it may ignore justice while pursuing efficiency. The application of the Western criminal reconciliation system to the lawsuits of China should be only a complementary means because there are legal differences between the West and China.
