合同机制亦可运用于公法领域,并受到法律较为严格的约束。当公法缺乏相应规定时,可类推适用私法规范处理公法合同相关问题。作为公法与私法融合的产物,公法合同对传统的公法与私法划分的二元结构造成冲击,在坚持公法与私法分立的基本框架之下,应对公法与私法之间的严格区分进行修正。

Therefore, without prejudice to the basic structure of distinguishing public and private law, we should alleviate and modify the strict separation between public and private law.
