监督过失是对被监督者过失行为注意义务的违反。监督过失中的注意义务违反存在两种表现形式：作为犯罪和不作为犯罪。监督过失主观上只能限于能够预见到被监督人的过失行为，不能扩展到对危害结果的预见。监督过失，存在监督者的过失和被监督者的过失，监督者与被监督者注意义务内容的不同决定了他们并没有形成一定的注意义务共同体。
鑑督過失是對被鑑督者過失行為註意義務的違反。鑑督過失中的註意義務違反存在兩種錶現形式：作為犯罪和不作為犯罪。鑑督過失主觀上隻能限于能夠預見到被鑑督人的過失行為，不能擴展到對危害結果的預見。鑑督過失，存在鑑督者的過失和被鑑督者的過失，鑑督者與被鑑督者註意義務內容的不同決定瞭他們併沒有形成一定的註意義務共同體。
감독과실시대피감독자과실행위주의의무적위반。감독과실중적주의의무위반존재량충표현형식：작위범죄화불작위범죄。감독과실주관상지능한우능구예견도피감독인적과실행위，불능확전도대위해결과적예견。감독과실，존재감독자적과실화피감독자적과실，감독자여피감독자주의의무내용적불동결정료타문병몰유형성일정적주의의무공동체。
Supervision-negligence is the breach to the wards of court, whose duty of care is negligent. In supervision-negligence, there are two kinds of manifestations in the breach of the duty of care： crime of commission and criminal omission. Supervision-negligence is only restricted to foresee the negligence of the ward of court＇s in subjective, the result of danger cannot be foreseen. Provost＇s negligence and and ward of court＇s negligence are included in supervision-negligence, and the different duties between provost and ward of court determine that they can not form a certain community about duty of care.
