从20世纪80年代,我国非农建设用地市场出现以来,政府垄断一直是城乡非农建设用地市场的重要特征。然而,随着市场经济的发展,这种垄断构想显然已经不能维持,各地集体非农建设用地的大量流转以及地方管理办法的相继出台昭示着城乡非农建设用地市场的迅速演化。本文通过分析我国城乡非农建设用地市场演化的内在逻辑。从制度变迁的角度,建立一个城乡非农建设用地市场演化的分析框架,讨论集体非农建设用地流转的条件,得出帕累托最优流转区间。在此基础上,通过比较静态分析。讨论各变量对集体非农建设用地流转的影响,并对一些实际问题作出解释。最后提出我国城乡非农建设用地市场演化规律,明确了市场演化方向。并指出其中的政策含义:不同地区、不同性质的集体非农建设用地具有不同程度的流转均衡,在不同的融期。影响因素的变化也将造成集体非农建设用地市场演化的不同状态。“一刀切”的做法可能会造成地区市场混乱或者给流转后的集体经济造成负担,尊重规律、区别对待是最优选择。

Since nonagricultural construction land market appeared in 1980' s, The monopolization of the government in the first market is the dominated character of the urban and rural nonagricultural construction land market at all times in China. Evidently, the monopolization thought of the government couhtn' t maintain along with the development of the market economics. Large numbers of rural nonagricultural construction land coming into the market and continuous ordination of parochial management regulation one after the other in China indicate the rapid evolvement of the urban and rural nonagricultural construction land market. By analyzing evolution prooess of the urban and rural nonagricultural construction land market, this paper establishes the analytical framework of the evolution of the urban and rural nonagricultural construction land market from the point of system transition. Based on the framework, we discuss the qualifications of rural nonagricultural construction land coming into the market through a comparative static analysis. Moreover, we elicit the Pareto optimal transferring interval. Then, by the comparative static analysis, we examine the effect of any change of the relevant factors on rural nonagricultural construction land coming into the market. Finally, v,,e give the explanations of some actual phenomena. At last, we put forward the evolution law of the urban and rural nonagricultural construction land market in China, make the direction of the urban and rural nonagricultural construction land market evolution clear, and point out the policy meaning of the evolution law of the urban and rural nonagricultural construction land market in China : There is different evolution level of rural nonagricultural construction land of different character in different district, In different stages, the change of influence factors will bring forth different rural collective nonagricultural construction land market evolvement status. Respecting the law and treating according to different circumstances will be the best way which we can choose.
