我国现行法律对农村建设用地进入市场采取了分类严格限制的办法。随着农村经济的发展以及城镇化进程的加快,现实中存在大量宅基地使用权的隐性流转。现行的宅基她管理制度亟待改革和完善。农村建设用地市场必须在政策和法律上寻求根本突破,必须从井艮瓠上改变土地制度的二元性,统一城乡土地市场。建议完善宅基地使用权登记制度,建立有偿、有期限宅基地使用制度,逐步放宽宅基地使用权的流转,充分保障农民在集体建设用地流转中的权益。

China' s current laws use a classifying way to restrict the flow of constructive lands into markeL With the development of rural economy and urbanization process, there are many hidden flow and transfer situations about the usufruct of homestead. Therefore, the existing management system of homestead needs improving. It is proposed that the market of constructive lands in rural areas need to seek a fundamental breakthrough in policy and law, including changing the duality of land administration system, unifying urban and rural land markets, improving the registration system of homestead usufruct, setting up a compensated use system of homestead, and relaxing the flow and transfer of homestead usufruct, thereby protecting the interests of farmers adequately.
