在国际私法领域对冲突规范进行软化处理已是不争的事实。虽然各国在实施程度上有所不同,但对于软化处理后的冲突规范所具有的灵活性是认同的。但是对于冲突规范软化处理的灵活性的价值目标及其体现环节和表现方式却存在不同认识,因而有必要对冲突规范的软化处理予以理性的认识。既要看到冲突规范软化处理所带来的积极效果,也要防止不适当对待软化处理,过分扩大其范围。

In the field of private international law conflict rules softening process is an undisputed truth.
