我国刑事再审程序存在“一事不再理”原则的空白化、启动主体的多元化、启动程序的任意化、再审理由的实体化、申诉规定的笼统化等问题。观念误区和具体国情是导致这些问题存在的主要原因，我们有必要采取相应措施加以完善。

There are many problems in our criminal retrial procedure such as vacuity of ＂non bis in idem＂ principle, diversification of the starting main arbitrary of starting proceedings, entities of retrial reason, generalization of complainant procedure. Misunderstanding concept and specific conditions of our country are the main reasons for these problems. We should take some measures to perfect our criminal retrial procedure.
