针对政府官员的“人肉搜索”已成为网络监督的主要方式之一，“人肉搜索”涉及到宪法上公民的监督权。监督权是公民重要的政治权利之一，但由于“人肉搜索”本身的特质以及公民知情权与政治表达自由的保障不力，造成我国宪法上的公民监督权规范与实践需求之间的紧张关系，使公民监督权在网络监督过程中产生了许多与宪法的相悖之处，表现为不论是在监督对象、监督方式以及监督内容上都产生了监督权行使的两难困境。

The human flesh search engine for the official which has become one of the main ways of the network superintendence,and it concerns the civil superintendence in Constitution. The civil superintendence in Constitution is regarded as one of the important political rights. But there is a serious conflict between the standard and the practice for the civil superintendence because of the quality of human flesh search engine and the shortage both in protection of right to know and freedom of political expression. These phenomena result in the opposition between the practical civil superintendence and the Constitutional regulation,and it appears as the predicament for superintendence exercising not only in the supervisory object, but also in the supervisory method and content.
