从中国职业体育制度形成的视角研究发现:目前中国职业运动员人力资本产权制度安排存在路径依赖。计划经济体制下,价值观高度统一,运动员人力资本产权制度安排存在特定的合法性;市场经济制度环境中,运动员作为一个利益主体已经觉醒,现有制度本质上依然延续着旧体制的安排,未能适应和尊重运动员意志的实现,存在运动员人力资本产权制度安排的滞后和缺位。提出新的运动员人力资本产权制度,首先,尊重运动员人力资本归属权的私有性;其次,在经营权制度安排上,建立市场经济职业联盟,使运动员人力资本在市场流动中实现利润增值,以尊重运动员意志的实现,使其效用得到最大化发挥。

From the study of developmental process of professional sports system, the current arrangement of human capital property rights system of China's professional athletes has the path dependence. Under the planned economic system, due to a high degree of unification of values, the arrangement of human capital property rights system of athletes has a unique validity. In the market economy environment, athletes as a main body of interest have woken up. While the existing system remains essentially the continuation of the old one, which does not fit to and respect the serf-realization of athletes. The current arrangement of human capital property rights system exists the lag and vacancy. This paper puts forward a new human capital property rights system of athletes. First, the privacy of athlete human capital ownership should be respected. Then, the market economical professional league should respect in or- der to realize the profit increment from the market circulation of human capital should be established. We self-realization of athletes, and maximize their effectiveness in the arrangement of management rights system.
