在司法实践中，普遍存在对涉嫌犯罪的外来人口过度适用逮捕强制措施的问题。应当采取多种措施、通过各种途径解决这一问题。这些措施包括：建立异地取保候审制度、附条件不批准逮捕制度、社区监管制度、证据说明制度，以及完善现有的取保候审制度、设置逮捕的司法救济程序等，以限制逮捕权的不当扩张，保障外来人口合法的人身权利。
재사법실천중，보편존재대섭혐범죄적외래인구과도괄용체포강제조시적문제。응당채취다충조시、통과각충도경해결저일문제。저사조시포괄：건립이지취보후심제도、부조건불비준체포제도、사구감관제도、증거설명제도，이급완선현유적취보후심제도、설치체포적사법구제정서등，이한제체포권적불당확장，보장외래인구합법적인신권리。
In judicial practice, the prevalence of immigrants suspected of crimes over the application of coercive measures to arrest the problem. We should take various measures through various channels to resolve this problem. These measures include ： the establishment of ex situ system released on bail, with conditions not approved the arrest of a system, community supervision system,evidence explanation system and improving the existing system of bail, setting up procedures for the arrest of judicial relief, so as to limit the inappropriate expansion of powers of arrest, external security of the personal rights of the legitimate population.
