目前，关于民办高等教育政府规制研究大部分均是从自然垄断和信息不对称的视角进行分析。经济学中“内部性”规制理论为民办高等教育的政府规制研究提供了一个新的视角。由于民办高等教育产业采用的是市场化运作方式，教育产品的特殊性使得民办高等教育市场存在“内部性失灵”，因为这种“内部性失灵”不能通过市场多次交易来解决，政府规制就变得必须。政府规制的重点应集中在提供民办高等教育产品“拥挤点”的信息上。

Analysis of government regulation in chinese private higher education at present are always from the perspectives of Natural Monopoly and Information Asymmetry. The theroy of Internalities in economics provides a new way for Analysis of government regulation in chinese private higher education. Because of chinese private higher education marketization, the particularity of the educational products make the market of chinese private higher education exist market failure of Internalities. Government regulation becomes necessary because the market failure of Internalities can＇t be resolved by market. From the aspect of Internalities regulation, the studying of government regulation policy and suggestion are supplied.
