巨大的商业利益使现代体育竞技充满竞争，能否通过对创新性体育方法授予专利权从而获得竞争优势，已不再是理论上空洞的探讨和研究了，美、澳等国家已开始向体育方法发明提供专利保护。从现行专利法的规范分析看，虽然许多国家的专利法没有明文将体育方法专利排除在可专利主题范围之外，但是基于专利制度和体育竞技本质的分析，宜认定体育方法在体育竞技领域处于基础性的思想地位，也不满足传统专利法上的实用性要求，从而不应成为专利法保护的客体。从经济分析的视角看，专利制度并非为激励体育方法创新所必须。而且，如果给与体育方法以专利保护，将有可能降低比赛竞争的激烈性，导致比赛结果不确定性的丧失，影响竞技体育的魅力。因此，体育方法发明不应当被授予专利。

Enormous profits result to fierce competition of modern sports, whether through awarding patents to innovative s.ports methods so as to gain competitive advantage is no longer a theoretical discussion but United States, Australia have already provided patent protection to sports methods inventions. From the normative angle of existing patent law, although patent law of many countries doesn＇t expressly exclude sports method patents form the scope of the patent, based on the analysis of patent system and the nature of sports competition, we should identify the basic status of Sports methods on the field of sports competition, besides, sports methods cannot meet the requirement of usefulness of traditional patent law so that it should be excluded form the subject matter of patent law protection. From the perspective of economic analysis, the patent system is not necessary to stimulate innovation in sports methods. Moreover, because of monopolization may reduce the intensity of sports competition, given patent protection to sports methods will result to the uncertainty of sport result and affect the charm of sports. In a word, the sports methods invention should not be patentable.
