人口老龄化是全球面临的共同社会问题。我国的老年型社会具有人口规模大、发展速度快、未富先老等特点。我国现有的监护制度存在诸多缺陷，不足以保护老年人的合法权益，亟须设立老年人监护制度。构建我国的老年人监护制度，因应监护法的现代发展趋势，借鉴国外成年人监护制度的改革经验，突破我国传统的监护理念，在制度设计上体现出尊重老年人意愿、区分被监护人多元化需求、为老年人提供更人性化保护和支持等特点。

Aging of the population is a common social problem faced by all the countries, the old - age society of China has such characteristics as huge population, fast developing speed, and getting old before being well - off. There are many defects in China＇ s existing guardianship system, which is not adequate to protect the old people＇ s legal rights. So it is urgent to establish the old people＇ s guardianship system in China. Establishing China＇ s old people＇ s guardianship system should conform to the tendency of the modem development of the law, and learn from the reform experience of the adult guardianship system in the foreign countries. We should not be restricted by the traditional guardianship idea. In the system design, the old people＇ s willingness should be respected, the multiple needs of the person under guardianship should be divided, and more human protection and support should be provided for the old people.
