患者知情同意权是患者在疾病诊治过程中的一项基本权利。其保护应以“最大限度保护患者的人格权”为核心理念，在特殊情况下应对它给予适当的限制，主要涉及患者知情同意权已经或将要损害社会公共利益、已经或将要损害第三人的合法利益以及法律明确授权限制的三类情形。在患者有同意能力的医疗紧急情况下，应当对患者知情同意权予以特殊保护。
患者知情同意權是患者在疾病診治過程中的一項基本權利。其保護應以“最大限度保護患者的人格權”為覈心理唸，在特殊情況下應對它給予適噹的限製，主要涉及患者知情同意權已經或將要損害社會公共利益、已經或將要損害第三人的閤法利益以及法律明確授權限製的三類情形。在患者有同意能力的醫療緊急情況下，應噹對患者知情同意權予以特殊保護。
환자지정동의권시환자재질병진치과정중적일항기본권리。기보호응이“최대한도보호환자적인격권”위핵심이념，재특수정황하응대타급여괄당적한제，주요섭급환자지정동의권이경혹장요손해사회공공이익、이경혹장요손해제삼인적합법이익이급법률명학수권한제적삼류정형。재환자유동의능력적의료긴급정황하，응당대환자지정동의권여이특수보호。
The patients＇ informed consent right in disease diagnosis and treatment is a fundamental right of patients. The core idea of protecting patients＇ informed consent right is to protect the patients＇ personality right to the maximum, and lay some limitation on it in exceptional cases. The limitation occurs in three situations： firstly, already or is going to harm the social public interests; secondly, already or is going to harm the third person＇s legitimate interests; thirdly, the conditions provided clearly by the law. Under the emergency when the patients have the consent capacity, the patients＇ informed consent right should be specially protected.
