对犯罪中止自动性的判断，我国的通说虽然立于主观说的正确立场，但过于概括模糊。在近来出现的判断自动性的两种新倾向中，规范的观察法从中止犯的立法目的出发是可取的，但其本身不应成为独立的判断标准；主观说与客观说相结合的思路则不具有合理性。自动性的判断应当符合中止犯的立法本意，从行为人的主观角度切入，核心是判断是否是“出于自己意志”的自愿放弃，对此可视犯罪代价有无升高分三种不同的情况来认定。

Referring to the judgment of voluntariness of discontinuation of a crime, China＇ s general doctrine stands on a correct position which exercises the judgment from the criminal＇ s subjective aspect. However, it＇ s too abstract and vague. Of the two new methods appearing recently, the norm-observation method, originated from the legislative aim of discontinued criminal, is advisable, but should not be taken as an independent standard by itself; the method of combining subjective theory and objective theory is not reasonable. The judgment of voluntariness should conform with the original idea of legislation and be made from the criminal＇ s subjective aspect. Its key lies in judging whether the discontinuation is voluntary or not, which can be affirmed by three different situations regarding that if the cost of crime is increased or not.
