法治对道德建设的推进作用贯穿于法律运行的全过程,立法则是法律运行过程的起点。文章从比较法的视角出发,从家庭伦理道德、社会公共道德与个人道德权利、义务的立法诉求等三个方面展开论述,归纳分析了西方立法与中国立法在上述三个方面的异同,从而体现立法对道德建设的推进作用。
法治對道德建設的推進作用貫穿于法律運行的全過程,立法則是法律運行過程的起點。文章從比較法的視角齣髮,從傢庭倫理道德、社會公共道德與箇人道德權利、義務的立法訴求等三箇方麵展開論述,歸納分析瞭西方立法與中國立法在上述三箇方麵的異同,從而體現立法對道德建設的推進作用。
법치대도덕건설적추진작용관천우법률운행적전과정,입법칙시법률운행과정적기점。문장종비교법적시각출발,종가정윤리도덕、사회공공도덕여개인도덕권리、의무적입법소구등삼개방면전개논술,귀납분석료서방입법여중국입법재상술삼개방면적이동,종이체현입법대도덕건설적추진작용。
Rule of law is penetrated in to the propulsion effect of the morality building in entire proceeding of law and legislation is the starting point of law running process then.The thesis sets off from the visual angle of comparison method,by discussing family ethics morality,society public morality and humanitarianism value to sum up and analyze the similarities and differences comment, west legislation and Chinese legislation to embody the legislation propulsion effect to morality construction.
