现行刑法总则部分并没有专门规定身份，理论界对身份的理解也没有达成共识，而身份与共犯交织，使问题更加复杂化。文章首先在论述共犯与身份基本内涵基础上，探讨身份犯的本质。在处理共犯与身份的定罪问题上应坚持法益侵害说；在处理有身份者与无身份者共同实施真正身份犯时，应采用实行行为说并以法益衡量原则为补充；在有身份者帮助和教唆无身份者实施真正身份犯时，必须重视我国将身份作为特殊主体构成要件的实际情况，应对有身份者按间接正犯处理，对无身份者作无罪处理，重点打击有身份之人。
