刑事司法职权优化配置，应正视和发挥律师辩护权作用，基于维护被追诉人合法权益，维护法律正确实施，维护社会公平和正义的责任与使命，律师辩护权配置应坚持控辩均衡的平等观，在公正与效率相协调原则下，以人权保障为立足点和落脚点，改革相关立法，完善司法救济机制。
