文章针对目前广泛存在的小产权房问题,结合十七届三中全会有关土地制度改革的精神,从社会和经济两个方面着重探讨了小产权房存在的现实合理性,并运用土地发展权原理,通过土地增值收益再分配的方式就小产权房的合法化进行了应用对策的尝试性研究,以期对小产权房问题的解决提供有意义的启示。
文章針對目前廣汎存在的小產權房問題,結閤十七屆三中全會有關土地製度改革的精神,從社會和經濟兩箇方麵著重探討瞭小產權房存在的現實閤理性,併運用土地髮展權原理,通過土地增值收益再分配的方式就小產權房的閤法化進行瞭應用對策的嘗試性研究,以期對小產權房問題的解決提供有意義的啟示。

Problems exist widely in small-scale property rights housing. Combining with the spirit on land system reform puts forward at the third Plenary Session of the 17th Communist Party of China Central Committee, this paper aims to analyse the reality and rationality of small-scale property rights housing. Based on relevant theories of land development right and analysis on the sharing mode of land incre- ment profit brought about by it, the paper makes an attempt to study the application countermeasures on the issue of legalization of Small - scale property rights housing, providing a practical significance to solve the problems in its existence.
