刑事审判职权优化配置是刑事审判改革的关键内容。作为一项系统工程，优化刑事审判职权配置要与刑事司法改革的目标保持一致，并应侧重追求内容的实效性。在具体优化措施上需要同时在有形的机能设置和无形的制度运行两个角度上有所作为——我们称其为“双维度”式的优化配置。进而言之，在有形的机能设置方面要兼顾外部体系以及内部体系两个层次；而在无形的制度动态运行方面则要在刑事陪审制度、刑事和解制度、刑事证据规则制度等多领域予以改革和创新。

The optimization of criminal trial authority is regarded as a key to the reform on the criminal trial. The paper argues for its agreement with reform on criminal justice in both tangible mechanisms and intangible system. Moreover, the tangible mechanism concerns with internal and external dimensions, while the intangible system needs reform and creativity in jury, compromise, and testimony.
