委托调解是对法官主导下诉讼调解工作适度社会化的新模式探索。法院委托调解是国家力量与社会力量共同参与的纠纷解决机制，在民间调解人指挥调解程序的背后是法院司法权的支持和支撑。委托调解虽然以当事人的合意为基础，但因为调解程序的开始和调解结果都有法院司法力量的介入，法官裁决或命令的作出有时会使当事人的诉讼权利受到一定的限制，因此，在法院委托调解中也应当强调当事人的程序保障权。

The court-entrusted mediation, which acts as a new exploration of appropriate socialization of the judge-led lawsuit mediation system,is a mechanism of resolving disputes by the collaborative engagement of state and social powers. The effectiveness of the mediator depends on and supported by the court＇s judicial power. Although consensus from the interested parties is the foundation of the entrusted mediation, the mediation process is intervened by the court＇s judicial power and the verdicts or orders given by judges sometimes cause certain restrictions on the lawsuit rights of interested parties. Therefore, the procedure guarantee rights of the interested parties should be concerned during the court-entrusted mediation.
