抢劫案件在司法实践中非常复杂，入户抢劫的认定是突显的疑难问题之一。尽管有两个司法解释为此提供了依据，但仍有相当多的问题难觅答案，值得研究。从案例分析入手，对入户抢劫中“户”的含义、功能性特征，商住两用房屋的定性，高法《意见》中住所的含义，入户时的犯罪目的等问题进行剖析，并在分析、结合入户抢劫的立法意图及本质特征的基础上，探讨入户抢劫的认定问题。

Robbery case is very complex in judicial practice, judgement of robbery while invading others ＇ house is one of the prominent problems. Although there are two judicial interpretations provided as the basis, there are still many problems to answer, which are worth studying. This paper analyzes this from these aspects, the definition of ＂household＂ and its function characteristics, the determination of the nature of commercial and residential dual-purpose houses, the meaning of residence in the opinions of the Supreme People＇s Court, the criminal purpose while invading others house, etc. and on the basis of the analysis, combining with the nature and legislative intent of robbery while invading others＂ house, discusses the issue of its judgement.
