处分权是所有权内容的核心，也是所有权最基本的权能。夫妻一方未经对方同意擅自处分共同财产，是侵犯对方财产权益的主要形式。本文重点探讨了该处分权的行使方式以及对受害方的救济措施。笔者认为，在日常家事和一般管理范围内，夫妻共同财产可以由夫妻一方单独处分，超出这些范围则须双方共同处分。夫妻一方未经对方同意擅自处分共同财产的，对方可以否定该处分行为，并可以提出分割共同财产。

The right of disposal is the core of property and the furthest powers and functions of it. One party＇s disposition of the community property without the other＇s agreement is the primary form of infringement on the other party＇s interest. This paper focuses on the methods of the exertions of the spouse＇ disposal of community property and the remedies for the victim, on the basis of expatiating the concept of this disposal. In writer＇s opinion, one party can dispose the community property on one＇s own on the range of the usual management and daily life, otherwise need the agreement of the spouse. If one party disposes the community property without the other＇s agreement, the other could deny this disposal and put forward community property division.
