高校教师申诉制度是一项针对教师的法定、专门的权利救济途径,同时随着我国高校与教师纠纷日趋增多且具有一定的特殊性,教师申诉制度的重要性更显突出。但由于教师申诉制度本身的设计缺陷,使其在实际运行中产生诸多问题。完善高校教师申诉制度,必须畅通教师申诉的途径,明确受理机构和受案范围;建立说明理由、听证、回避等制度,保证申诉处理结果公正、公平、合理;明晰申诉与行政复议、行政诉讼的关系,拓展申诉后救济渠道。

Teacher＇s appealing system is a legal and special right relieving system for the Chinese teachers,while with the disputes between universities and teachers our country are increasing gradually together with particularity,the importance of teacher＇s appealing system is even more prominent.However,there are evident flaws with teacher＇s appealing system stated in itself,so that arising some problems in practice.Improve the appeal system for university teachers,we are obliged to smooth the approach of the appeal system for teachers,has a clear case of receiving institutions and range;Build the system that explaining a reason,a hearing,avoidance to ensure the appealed result is just,fair and reasonable;Clarity the relation that appeal with administrative reconsideration,administrative ligigation,widen the relieving channels for appeal.
