建构现代大学制度是我国高等教育改革与发展的目标，而现代大学法律制度是建构现代大学制度的基础。转型期之中国，大学制度化、现代化进程业已开肇，但现有的大学法律制度明显滞后且显现出诸多缺陷和弊端。只有对其全面修订和完善，经由立法主导高等教育发展方向，进而建构现代大学法律制度体系，方能走出“路径依赖”的窠臼，确认和巩固高等教育改革成果，保障高等教育持续健康发展，实施科教兴国与人才强国战略，实现高等教育和社会发展目标。

It is the objective of the higher education reform and development in China to establish a modern system of universities, which lies on a legal system on modern universities. Institutionalization and modernization of the university system have started in China in the transition period while the legal system concerning universities is backward and defective. Only when the legal system of universities are modified and improved and the direction of higher education is incorporated in legislations that path dependence can be avoided, achievements in higher education reform can be reinforced, higher education can develop in a sustainable way, the strategy of reviving the country by science and education and talent development can be implemented,and the objectives of higher education and social development can be achieved.
