产权制度是关于稀缺资源利用的权利行为规则安排。排他性权利界分是产权发挥作用的前提性条件。现行农地产权制度呈弱排他性，主要表现为：农地所有权缺少排他性；农地使用权排他性虚弱；农地处分权排他性不强；农地收益权排他性有限。改革和完善农地产权制度，必须转变指导思想，整体推动农弛非排他鼍产权制度变迁，完善农村集体土地所有权制度，构建物权性农地承包经营产权制度，复造民事化农村集体建设用地产权结构。

The property system is a rule arrangement of the right conduct on the scarce resources. The exclusive right is the prerequisite condition for the property right to play role. The exclusion of the existing agriculture land property is weak, which shows in the following aspects： the weak ownership right of the agriculture land, the weak use right on the agriculture land, the weak disposal right of agriculture land, the weak income right of the agriculture land. To reform and complete the agriculture land property system, we should transform the guiding ideology, promote the transition of the non-exclusive right, improve the ownership system of the rural collective land, construct a real right to land contractual management rights system, establish a new property right of the rural collective construction land.
