在中华人民共和国成立的六十年里,知识产权刑法立法历经了前期近三十年的缓慢初创阶段、改革开放后的快速发展阶段与形成体系阶段,最终取得了举世瞩目的成就。整个知识产权刑法立法历程始终受着中国社会政治、经济、科技与文化状况与发展需求的制约,也反应与促进了中国社会经济、科技与文化的发展;但随着现代社会经济、科技与文化的快速发展,现行的知识产权刑法规范也出现了与相关知识产权法不协调等不足与缺陷,亟待完善。
재중화인민공화국성립적륙십년리,지식산권형법입법력경료전기근삼십년적완만초창계단、개혁개방후적쾌속발전계단여형성체계계단,최종취득료거세촉목적성취。정개지식산권형법입법역정시종수착중국사회정치、경제、과기여문화상황여발전수구적제약,야반응여촉진료중국사회경제、과기여문화적발전;단수착현대사회경제、과기여문화적쾌속발전,현행적지식산권형법규범야출현료여상관지식산권법불협조등불족여결함,극대완선。
In the past six decades since the People＇s Republic of China was founded,the legislation of the criminal law of intellectual property has gone through several stages：the initial stage of slow development lasting about thirty years,the fast development stage since the reform and opening-up,and the stage of system establishment,and eventually obtained outstanding achievements. The whole legislation process has been restricted by the actual condition and development need of politics,economy,science technology and culture in China. At the same time,the process has also illustrated and accelerated development in the above sectors. But with the fast development of economy,science technology and culture in the modern society,the current criminal norms of the intellectual property cannot coordinate with the related laws of the intellectual property. Therefore,it is necessary to rectify the deficiencies and defects in a timely manner.
