在社会转型时期，由于犯罪现象本身呈现出与常态社会的极大不同，以保障人权和追诉犯罪为目的的刑事强制措施也得因之变化。监视居住是《刑事诉讼法》规定的一种强制措施，但现如今，其制度生存的社会根基被剥离，适用条件违反了比例原则，适用空间极其微小，以及无法破除的执行困境等废除理由的凸显和强化，它必将日渐式微并最终被废除。
在社會轉型時期，由于犯罪現象本身呈現齣與常態社會的極大不同，以保障人權和追訴犯罪為目的的刑事彊製措施也得因之變化。鑑視居住是《刑事訴訟法》規定的一種彊製措施，但現如今，其製度生存的社會根基被剝離，適用條件違反瞭比例原則，適用空間極其微小，以及無法破除的執行睏境等廢除理由的凸顯和彊化，它必將日漸式微併最終被廢除。
재사회전형시기，유우범죄현상본신정현출여상태사회적겁대불동，이보장인권화추소범죄위목적적형사강제조시야득인지변화。감시거주시《형사소송법》규정적일충강제조시，단현여금，기제도생존적사회근기피박리，괄용조건위반료비례원칙，괄용공간겁기미소，이급무법파제적집행곤경등폐제이유적철현화강화，타필장일점식미병최종피폐제。
In the social transition, because phenomenon of crime in itself shows a great deal of difference with the normal society, criminal coercive measures, which is to protect human rights and prosecute crime, also have changed. Residential surveillance is a kind of criminal coercive measures in Criminal Procedure Code,however,the social foundation of its life is stripped now, the applicable conditions violate the principle of proportionality, the applicable space of it is very narrow, and it cannot get rid of the dilemma of implementation. All of the reasons above gradually make residential surveillance declined and eventually abolished.
