我国检察委会的回避制度存在诸多漏洞和弊端,由于立法上没有明确的规定,导致在司法实务方面缺乏操作的可能性。作为一个保障实体公正的诉讼程序,检察委员会的回避制度能否发挥其应有的功效,不能单单依赖回避制度本身,还需要完善该制度的上游和下游的其他相关联的诉讼制度。文章认为,构建检察委员会的回避制度不仅有利于确保实体公正和程序公正的实现,而且有利于增强司法的权威性,维护社会的和谐稳定。

The Challenge system of the Procuratorial Committee in China has many loopholes and drawbacks.Because of no explicit legislative provision in legislation,it results in the lack of operational possibility in judicial practice.As a judicial procedure guaranteeing substantive justice,whether the Challenge system of the Procuratorial Committee can fulfill its proper function or not,should not only rely on the Challenge system itself,but also need to consummate other associated litigation system of the upper and lower chains of the Challenge system,such as the inspection open system,the whole challenge system,etc.The paper claims that the Challenge system of the Procuratorial Committee helps not only ensure the implementation of substantive justice and procedural fairness,but also strengthen the judicial authority and maintain social harmony and stability.
