犯罪动机作为重要的酌定量刑情节,对于死刑的限制适用具有重要意义。犯罪动机限制死刑的适用,可以犯罪动机的社会性质作为切入点。犯罪动机属于有益社会动机的,不应适用死刑;犯罪动机属于中性动机的,一般不适用死刑立即执行;犯罪动机属于有害社会动机的,是否适用死刑应根据具体情况而定。如果未造成多人伤亡的极其严重后果或者犯罪动机反社会的性质未达到特别恶劣的程度,也可考虑不适用死刑立即执行。

Criminal motive, as a key factor of discretionary sentencing, has an important meaning for restrict- ed application of death penalty. The application of death penalty is restricted by criminal motive, so we can take social attributes of motives as a clue. If the motive is triggered by benefiting society, death punishment is not applied ; if a neutral motive occurs, summary execution is not available ; if damaging society, and the mo- tive should be punished according to actual consequences which decide execution or not. If extremely serious results were not incurred such as heavy casualties or anti-social motives were not a particularly flagrant case, summary execution may be inapplicable.
